    “…The relevance of this kind of research is caused by the need to address the economic, financial and legal nature of tax risk.Due to the urgency in the study set a goal - to analyze the possibility of minimizing tax risks and prevent their negative consequences.The goal made it necessary in dealing with the serial number of problems, namely:• Consider diff erent perspectives on the concept of "risk";• To analyze the concept of "fiscal risk" and the possible negative consequences of tax risks in relation to the taxpayer;• Provide tax risk classification on the following criteria: on the subjects, their bearing; on the occurrence of sources; on the occurrence of factors, and make their grouping: largest possible losses; by type upcoming consequences.The solution of the latter problem will improve the understanding of the essence and nature of manifestations of tax risks.The study is based on the application of theoretical and empirical approach to tax risks, which allows participants to tax relations assess tax risks, to take measures to prevent or minimize signifi cant.The result of the study was a detailed analysis of the "undue benefit" category as one of the tax risks; as well as an attempt to systematize risk for reasons of his presence indicators, based on which recommendations on the need for enterprises organizational protection structures are given in the form of tax administration services (for large enterprises) or the use of a specialist (consultant) on taxation (for small and medium enterprises ), directly subordinate to the CFO, while the performance of their tax accounting functions.The outcome of the study was the conclusion of a possible mechanism for reducing the tax risk, which consists in the implementation of eff ective technology of internal fiscal control and to ensure eff ective measures of adequate protection in the event of confl ict with the tax authorities and tax inspectorate.…”
