Summary:Purpose. The purpose of the work is to study the administrative and legal basis of the formation of tariffs for freight railway transportation, analysis of the procedure of tariff formation, control and supervision in this area, clarification of the main problems of the industry and providing proposals for ways to solve them. Methodology. The methodology includes a comprehensive analysis of normative legal acts and generalization of available scientific and theoretical material (primarily in the field of administrative law), formulation of relevant conclusions and recommendations. Results: it was determined that on the modern market of freight rail transportation, the main service providers are JSC “Ukrzaliznytsia” and operators of rolling stock – independent business entities that, based on contracts with the railway and shippers, participate in the process of transporting goods using their own rolling stock or rolling stock that they legally own. Currently, there is a clear division of tariffs into state-regulated tariffs and free tariffs for which JSC “Ukrzaliznytsia” independently sets the cost of services. Tariffs for the transportation of goods by railway are determined by applying basic tariff rates, coefficients and tariff classes of goods. Originality. In the process of research, it was established that the current problems of administrative and legal regulation of the rail transportation market consist in the presence of certain restrictions related to state control of tariffs, which significantly affect the competitiveness of the industry. As a result, the balance of support for the interests of the state and business is not ensured. Practical significance. The results of the research can be used in legislation and law-enforcement activities during the inquiry of crimes related to human trafficking and corruption.
