Description
Summary:Kufa played an important role in the formation process of fiqh sects from the Prophet Mohammad to the mujtahid imams. The leading names of the Kufe fiqh school, known for its rationalism, are Abdullah ibn Masʽud (d. 32 / 652–53) and his students. Many scholars have conveyed the scientific activity carried out in ibn Masʽud ’s assemblies to the next generation. The most famous of these scholars are Alqama ibn Qays (d. 62/682) and Aswad ibn Yazid (d. 75/694). This study has focused on Aswad ibn Yazid and his position in the history of fiqh. In this context, first, his life and his scientific personality were described, and then the effects of the tābi‘ūn, who were educated by the generation of the sahābah, on the formation of fiqh sects were explained. In the context of the narratives about Ibn Yazid, scholars have attempted to determine his position in the history of fiqh. Detailed information was given about the influence of the Hanafi School of Law onthe formation of the Kufa-centered fiqh activity. This account has been confirmed by his fiqh methodology and his exemplary views about the Furûʻ al-Fiqh. As a result, we arrived at a conclusion about the nature of the task he performed in the formation of the Hanafi School of Law.
