En las siguientes líneas se pretende argumentar a la luz del ordenamiento jurídico español la existencia de razones jurídicas (válidas y suficientes) para catalogar como “criterio interpretativo de los Derechos Fundamentales” a los Tratados Internacionales de Derechos Humanos, aportando cuatro tipos de argumentos: El primero, se deduce de la naturaleza jurídica de los tratados como fuentes del Derecho Internacional y como obligaciones internacionales para el Estado. El segundo, deriva de la incorporación automática de los Tratados al Derecho interno consolidándose como parte del ordenamiento jurídico. El tercero, es la pauta interpretativa que cuenta con respaldo constitucional en el artículo 10.2 de la Constitución Española. El cuarto, deriva de la insuficiencia de los criterios tradicionales al momento de interpretar las normas de los Derechos Fundamentales
ABSTRACT.
The following lines pretend to argue in light of the Spanish law the existence of legal reasons (valid and sufficient) to classify the international human rights treaties as "interpretive criteria for Fundamental Rights", providing four types of arguments: The first is inferred from the legal nature of treaties as sources of international law and international obligations for the State. The second derives from the automatic incorporation of treaties into national law establishing itself as part of the law. The third is the interpretative guidance that counts with constitutional support in Article 10.2 of the Spanish Constitution. The fourth derives from the failure of the traditional criteria when interpreting the rules of Fundamental Rights.
