| Summary: | Objective: to reveal the legal nature of the comments to articles of the Criminal Code of the Russian Federation for indemnity, to show the ways of solving the problem of their implementation. Methods: universal dialectic method of cognition, and general scientific, special and private law research methods based on it. Results: on the basis of analysis and generalization of the results of the investigative and judicial practice, the provisions of the legislation and criminal law doctrine the author discloses the legal nature of the comments to articles of the Russian Criminal code for indemnity and ways to solve the problem of their implementation. Scientific novelty: the grounds and conditions are set and differentiated for indemnity, enshrined in the comments to articles of the Russian Criminal Code; ways are shown to solve the problems of criminal-legal provisions of these comments. Practical value: the results of the conducted survey can be used in scientific, legislative and law-enforcement activity and also in the educational process of law schools and faculties. |
