description | The law of modernization of the economy voted August 4th, 2008 introduced a new statute of individual entrepreneur, the auto-entrepreneur, whose one of the main goals was to support the competitiveness of the national economy by promoting entrepreneurship. The purpose of this paper is to raise some questions and to discuss the model of the entrepreneur who underlies this law, referring at the core elements of the theory of the firm and its legal application. The auto-entrepreneur regime is assessed referring to the principle of independence and its different meanings. Three forms of autonomy are privileged: productive autonomy (section 1), implying the availability of financial and material resources required to provide really professional services; autonomy of decision (section 2), which determines the capacity to assume the entrepreneurial risks and autonomy of earnings (section 3), which measures the possibility of obtaining means of subsistence thanks to its work. We conclude stressing that this model appears especially adapted to the undertaking of an additional activity as a complement to a part time work or retirement, what contradicts every theoretical approaches of the enterprise. |
