Summary:This paper examines the controversial subject of pecuniary and non-pecuniary losses in wrongful birth and wrongful life cases. The author addresses these issues from a comparative perspective, presents the main arguments for and against awarding damages, and offers a critical analysis of the newly enacted rules of Serbian tort law concerning the birth of a child who would not have been born were it not for negligence on the part of a medical doctor.
