Summary:In recent years, the practice of data intellectual property has developed rapidly, yet there remains considerable debate within the theoretical community, particularly regarding whether the data production process involves creative labor—a pivotal criterion in determining a dataset’s eligibility for intellectual property rights. This paper examines the potential forms of creative labor in both primary data production and data reproduction, proposing four possible types of creative labor for each. The findings provide theoretical support and a foundation for the substantive review process in current data intellectual property registration, as well as for the construction of a data intellectual property system and the formulation of related policies.
