Description
Summary:This paper presents a thorough Shari'ah-based discussion of rulings related to mortgages in the contemporary era. The mortgage system, in which individuals or institutions pledge property as security for loans, has grown to be an important component of modern financial arrangements. The study evaluates the degree to which Islamic principles can be implemented within the context of contemporary legal and economic systems by looking at the Shari'ah status of mortgages through the perspectives presented by various Islamic jurisprudential schools. The research paper also addresses the topic of interest (Riba) in contemporary mortgage arrangements, as well as the implications under Islamic law. Additionally, it investigates how Islamic jurisprudential mortgage concepts might be modified to accommodate modern situations, guaranteeing Shari'ah compliance while avoiding clear of interest-based transactions. Finally, the paper discusses many academic perspectives on mortgages in the current world and suggests ways to assist Muslims in navigating mortgage-related issues in accordance with Islamic teachings.
