The commission of an offense against the environment can result in corresponding damage. This refers to civil-law consequences arising from the commission of such offenses. Compensation for damage caused by offenses against the environment may be obtained out of court and in court. Compensation for damage can be claimed in court in two ways: 1) within the penal proceedings themselves, based on a submitted property claim (the so-called adhesion procedure), and 2) in civil proceedings after the completion of the penal proceedings. Accordingly, this paper examines certain issues related to the characteristics of such damage, as well as the corresponding procedural questions on obtaining compensation. In order to adequately address this topic, it is necessary to briefly show the main features of the protection of the environment through penal law. |
