description As a political scientist, taking the competence of appointment as the object of study presupposes a prior sociological critique of the concept of legal norm by inviting us to grasp the social conditions of its validity. This Weberian method applied to the post-revolutionary reformulation of appointment has made it possible to reappraise the history of this prerogative in a different way. In fact, a reading of Abbé Sieyès' project for the 1799 constitution from the point of view of the distribution of posts shows that the prevalence of appointment over election must be analysed as a mechanism for censoring the election. This article thus intends to show how a watchword of moderation of passions contributes to legitimize the invention of this mechanism of election control which characterizes the republican reinvention of this competence.
