Summary:In 1993, Giulio Andreotti, one of the eldest and most important leaders of the Christian Democracy, was charged by the Tribunal of Palermo with complicity with the Mafia. Given the calibre of the defendant, the meaning of the trial has outreached the question of criminal responsibility. In the public debate, the trial has turned into a broad examination of the critical judgments concerning Andreotti’s political personality, the relationship between the mafia and part of the Italian ruling class, and the “criminal” aspects of Italian republican history. That is the reason why Andreotti’s absolution in 1999 has been interpreted as the rehabilitation of his political role and the so called “First Republic” with which he was identified. The article analyzes the factors that have made possible the confusion between the penal and the political spheres, as well as the effects of such confusion on the political formulation of the mafia issue.
