Summary: | Health is a field particularly suitable for notions as commons or public goods. It is necessary however to know which goods may be concerned. For instance, French lawyers use concepts which can be used in order to qualify right to care (as an inalienable right), or medicine as an object of intellectual property as well as “traditional” one. An international law for health goods could be also based on a right of use for each person on the molecule which is the same in the generic drug or in the patented one. A process of “equivalent access” to licensed or free products could be initiated, from the discovery itself to the use, in order to obtain rapidly fair prices. |
