Summary:Abstract State intervention in some families in Brazil is crossed by stigmas and ingrained beliefs. Giving birth to a baby is different from forming a parenting bond. Based on the legal devices to intervene with "non-protective" families or those who express a desire for voluntary adoption surrender, we propose a critical reading of how the State action affects parenting. A study of two cases was carried out based on records and interviews with the team of a foster care service. Despite the legislation contemplating reproductive rights, family and community rights, the practice of many professionals threatens the rights of some poor women, with history of violence, mental suffering and/or drug use, to raise their children.
