Summary:The article asserts the crucial influence of the constitutional Commerce Clause on the effectiveness of the Civil Rights Act of 1964 and thereby the formal abolition of racial segregation in the United States of America. Why precisely did the Commerce Clause, the provision establishing the exclusive jurisdiction of the federal government over interstate commerce, prove to be an effective tool in combating state regulations discriminating against racial minorities? To answer this question, it is crucial to analyze the position and role of the United States Supreme Court in the American system of government, along with the importance and character of the Court’s interpretation of constitutional norms. Demonstrating the correlation between the consistent application of expansive interpretation by the United States Supreme Court regarding the Commerce Clause and the effectiveness of the Civil Rights Act of 1964 forms the basis of this article’s analysis.
