Summary: | The Mauritanian Constitution of July 20th, 1991, offers a compromise between Islam and secular democracy, defining a “Presidential system” strongly marked by the power of the Executive. It is adopted within the framework of the «democratization» of the military regime in 1991 and experienced two periods of suspension: following coups d’état of August 3rd, 2005 and August 6th, 2008. After a first revision in 2006 limiting the duration of the presidential term of office, it was amended again, according to constitutional law of March 20, 2012, pursuant to the Agreement of Dakar putting an end to the constitutional crisis raised by the 2008 coup d’ État. The 2012 amendment legally codified the terms of the “Political Agreement” signed on October 19th, 2011, between the presidential majority and certain opposition parties, following on the winds of change announced by the Arab Spring. Considering the timing of the event and the prolonged adoption process, the 2012 law confirms the president’s term in office and as well as the powers and legitimacy of the Parliament elected in the balloting of November 19 and December 3, 2006. The present study analyzes the context of the revision of 2012, and offers a comparative approach in evaluating the validity and contribution of the law to consolidating the fundamental values and stability of Mauritanian political society. By institutionalizing cultural diversity, banning slavery and prohibiting “coups d’état” the 2012 amendment makes a number of minor but useful adjustments. |
