Summary:The negative effects of gender stereotypes on gender equality have been acknowledged in Law for decades. The legal obligation to eliminate gender stereotypes derives from the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW), and it has been echoed in the legislation and case law regarding equality between women and men at the European, Spanish state and regional/autonomic level. This article explores the formulation and scope of the legislative and jurisprudential treatment of gender stereotypes from an intersectional perspective, focusing on the legal reality of the Basque Country.
