| Summary: | This paper questions the stance in legal doctrine and case law regarding the legal foundation and nature of the regime of communications and stays in a context of gender based violence. We will analyze how such qualitative discourses, seemingly neutral, influence the construction of the minor's interest and the suspension of that right in a scenario of gender violence. We will see how that stance is defined by patriarchal interests which reinforces the father's predominant rights rather than the right of sons and daughters to a life free of violence. This approach considers that keeping contact with his/her father is required for the development of the child. |
