description The article aims at describing the concomitance –in the Italy of the 1990s– of a judicial criticism of politics, which sees an unprecedented visibility in the public sphere, and of the representation of the judicial function as essentially a notarial activity consisting in making the inventory of illegal actions. The study thus attempts to consider these two elements, apparently in contradiction, as a unique process of redefinition of the judiciary and their role in the Italian democracy, with reference to a new model of excellence, that is to say a model designed in the judicial battle against economic criminality, political corruption and organized criminality.
