Resumen: Las feministas tradicionalmente han criticado el derecho como un instrumento de opresión de las mujeres. Se ha duda sobre la capacidad del derecho de transformar la realidad y ser capaz de traducir legalmente las demandas políticas de las mujeres, mejorando sus vidas. Además, los últimos movimientos feministas han sido muy escépticos con la viabilidad de la categoría “mujeres” como sujeto del derecho. Este artículo analiza estas dudas y críticas recuperando algunas de las propuestas hechas por las juristas feministas para crear nuevas categorías jurídicas que incluyan las demandas y necesidades de las mujeres y desplacen la importancia del sujeto.
Abstract: Feminists have traditionally criticized law as a patriarchal tool for women’s oppression and have severely put into question the presuposed universal and neutral subject of law that have left aside the women’s demands and rights’ protection. This has leaded to question the law’s ability to change reality and translate into law the women’s political demands, improving their lives. On top of that, the latest feminists’ movements have been very skeptical about the viability of the category “women” as subject of law, since it is a diverse and questionable subject. This paper analyses these doubts and criticisms recovering some of the proposals made by feminist legal scholars to create new legal categories that include the women’s demands and needs and displace the importance of the subject to focus instead on the inequality causes.
