Summary:Cases regarding the recognition of property rights to an unauthorized structure or its demolition often become the subject of judicial examination. These claims are often unjustifiable, which means unfair practice of one of the parties. Unauthorized developers and illegal legalization of unauthorized structures are a major issue dealt with by administrative bodies and courts. Not only do unauthorized buildings fail to meet safety standards, but they also pose a danger to the life and health of citizens, as well as violate the rights and legitimate interests of stakeholders. However, legalizing unauthorized structures under certain circumstances remains an unchanging normative tradition. Legislation in the field of unauthorized construction is regularly updated: each time, judicial instances have to provide explanations and publish summaries of good judicial practice. The authorities try to find a balance of interests and avoid unwarranted biases both in favor and against unlicensed developers. Much here depends on the assessment of the behavior of stakeholders from the perspective of good faith. The article summarizes the current legal positions and ambiguous examples of judicial practice from the perspective of fair or unfair practice. The analysis revealed no unified approaches to the issue of recognizing ownership of an unauthorized building or its demolition.
