Summary:This article analyzes the contribution of the European Convention on Human Rights (ECHR) and of the European Court of Human Rights to the protection of the rights of children in conflict with the law. More specifically, it discusses Articles 3, 5, and 6 of the ECHR and related jurisprudence of the European Court of Human Rights in cases of children in conflict with the law.Although the ECHR contains few direct references to children’s rights, the European Commission of Human Rights and the European Court of Human Rights have made considerable contributions to the promotion and protection of children’s rights. In cases of children in conflict with the law, alongside the negative restrictions imposed on member states, the European Court of Human Rights adopted a relativist and wider interpretation of Articles 3, 5 and 6 of the ECHR and imposed positive obligations to the member states, drawing namely onthe provisions of the UN Convention on the Rights of the Child (CRC).
