| description | Child rightsare part of human rights contained in the 1945 Constitution and the United Nations convention on the Rights of the Child. In terms of national and state life, children are the future of thenation and the future generation of national ideals, so that children have the right to survival, to grow and develop, to participate and to be entitled to protection from acts of violence and discrimination and civil rights and freedom. However, in the current situation, child crime continues to increase, especially sexual crimes against children, and perpetrators of crimes against children according to the National Commission for the protection of children are the closest people to victims (children), including father, mother, uncle, friend, and boyfriend. Crimes against children themselves have been governed by positive law in Indonesia, for example in the Criminal Code Article 288 & 289 of the Criminal Code, and more specifically regulated in Law No. 35 of 2014 changes to Law No.23 of 2002. Associated with cases of intercourse with children in the study of decision No.74 / Pid.Sus / 2018 / PN / Mrs. The Panel of Judges who made a ruling on the perpetrator, where the perpetrator was the stepfather of the child, the verdict still did not fulfill the sense of justice fromthe victim, this was based on the rule of law in Law No. 17 of 2016 which reads if the perpetrator of sexual crime towards children still in the environment of the closest person (father), the penalty is added to 1/3 of the criminal threat, and from the legal considerations of the judge there are no things that alleviate the defendant. |
